We support our clients in enforcing and defending trademark rights. If you are accused of trademark infringement—for example, in the form of a cease-and-desist letter—we are here to defend your position.
First, we examine whether a trademark infringement has actually occurred and what the chances of success in a court case would be. Our team identifies the weak points of the opposing party's trademarks and analyzes possible defenses and counterattacks. Based on this, we develop the best defense strategy for your company. In many cases, a cease-and-desist letter can be resolved through a mutual agreement that takes both parties' interests into account. Sometimes, however, litigation is unavoidable. In these cases, we fight for our clients – legally and strategically.
A strong brand shouldn't be weakened by third parties using similar signs or even imitating the brand. We therefore monitor trademark registers for similar new applications and domain registrations to identify potential infringers early on.
Depending on the trademark situation, corporate policy, and corporate image, we address trademark infringements (e.g., with a cease-and-desist letter or a legal letter). Should an infringer not cooperate, we will, of course, also file a lawsuit to enforce our clients' trademark claims.
If a similar trademark is registered, we can file an opposition with the trademark office to prevent the trademark from being registered or to have it cancelled. If an opposition is no longer possible or is not feasible for other reasons, we will consider other procedures, such as revocation and invalidity proceedings, to overturn the trademark.
