Der Grund: Es handelt sich dabei um einen klar beschreibenden Begriff, der die Art des Produkts pr\u00e4zise beschreibt. Ein solcher Begriff kann nicht als Marke eingetragen werden, da er keine ausreichende Unterscheidungskraft besitzt. Konkret bezeichnet \u201eGruselkeks\u201c im Bereich der Back- und Konditorwaren einfach s\u00fc\u00dfe, haltbare Kleingeb\u00e4cke oder Kekse, die mit f\u00fcr Halloween typische \u201egruselige\u201c und \u201egespenstische\u201c Motive oder Verzierungen versehen sind. Das Markenamt hat hierzu in seiner Entscheidung (EUIPO, vom 18.12.2020, Az. 018288789 \u2013 GRUSELKEKS) klargestellt, dass der Begriff in diesem Zusammenhang lediglich eine allgemeine Produktbezeichnung darstellt und keine origin\u00e4re Markenfunktion erf\u00fcllt.<\/p>\n<p data-start=\"1118\" data-end=\"1234\" data-is-last-node=\"\" data-is-only-node=\"\">Daher k\u00f6nnen Sie den Begriff bedenkenlos f\u00fcr Ihre Halloween-Kekse verwenden \u2013 und das ganz ohne rechtliche
