The European Union Trademark Office (EUIPO) recently decided to refuse trademark protection for the term "INSTANT SNOW" in connection with Christmas tree decorations. The reason: The term is purely descriptive and merely contains information about the nature and quality of the goods, making it unsuitable for trademark protection. "INSTANT SNOW" clearly conveys that it is artificial snow that can be used immediately. Artificial snow is often used as a decoration, especially for Christmas tree decorations, especially during the Christmas season, according to the EUIPO. Because the term serves only a descriptive function and lacks any distinctive trademark characteristics, trademark protection was refused.
